Terms and Conditions of Use

“liane-joaillerie” is a website, available at liane-joaillerie.com (the 'Site').
This Site is edited by Liane Fleischer, an individual entrepreneur (business owner). This entrepreneur is registered in the PARIS Trade and Company Register under the identification number 882 753 882 RM 75, (hereinafter the 'Publisher'). “liane-joaillerie” is accessible to users (the 'User(s)').
The purpose of these Terms and Conditions of Use (the 'Terms' or taken as a whole, the 'Agreement') is to define the terms and conditions governing the relationship between Users and Liane Fleischer. In the event of non-compliance with the terms of the present Terms, Liane Fleischer reserves the right to take any measure likely to preserve its interests and in particular to ensure their execution.
The User agrees, with the use of the website, to comply and be bound by these terms and conditions without reservation. If the User accesses the website on behalf of a company or any other legal entity, he/she is nevertheless personally bound by this Agreement.
These terms and conditions may be modified, particularly to accommodate any regulatory changes. The new terms and conditions apply as soon as they have been posted.

ARTICLE 1: PURPOSE OF THE SITE

The Site gives the User access to the following services: creation, production, sale and repair of handcrafted jewelry pieces (the 'Service(s)').
Liane Fleischer (liane-joaillerie), in accordance with these terms, grants Users a limited, revocable, non-exclusive, non-transferable right of access to the Services on a strictly personal basis. Any use of the website opposing this purpose is strictly prohibited and constitutes a breach of these terms.

ARTICLE 2: ACCESS TO THE SITE

To be eligible for the Services, the User may (a) have reached the age of majority and (b) have the legal capacity to enter into contracts.
Liane Fleischer reserves the right to suspend or refuse access to the Site to one or more Users.

ARTICLE 3 : SITE MANAGEMENT

The Publisher implements the necessary technical solutions to allow continuous access to the Site for the User. However, the Publisher reserves the right to limit or suspend access to all or part of the Site at any time, without prior notice. Such an interruption may be necessary for reasons of maintenance of the site or its content, or for any other reason deemed necessary for the proper functioning of the site by the Publisher.

All hardware and software required to access the website and to use the Services are the sole responsibility of the User.

ARTICLE 4 : REPORTING

The user can contact the Publisher to report any illicit or obviously inappropriate behavior or content. Such a report can be made by email at contact@”liane-joaillerie”.com.

ARTICLE 5: USE OF THE PLATFORM'S SERVICES

The User shall refrain from:
1. transmitting, publishing, distributing, recording, or destroying any material, in particular the contents of “liane-joaillerie”, in violation of laws or regulations in effect concerning the collection, processing or transfer of personal information.
2. to disseminate data, information, or content of a defamatory, insulting, obscene, offensive, violent, or inciting to violent nature, or of a political, racist, or xenophobic nature and, in general, any content that is in opposition to laws and regulations in effect and/or good morals.
3. to reference or create links to any content or information available from the “liane-joaillerie” websites, except with prior and written consent of Liane Fleischer.
4. use information, content, or any data present on the Site to offer a service considered competitive to “liane-joaillerie”.
5. sell, exchange or monetize information, content or data present on the website or the Services offered by the website, without prior written consent of Liane Fleischer.
6. reverse engineer, decompile, disassemble, decrypt, or otherwise attempt to obtain the source code for any underlying intellectual property used to provide all or part of the Services.
7. use any manual or automated software or devices, robots, or other means to access, crawl, retrieve or index any page of the Site.
8. endanger or attempt to endanger the digital security of “liane-joaillerie”. This includes attempts to monitor, scan or test system or network vulnerabilities or to breach security or authentication measures without prior written authorization of Liane Fleischer.
9. infringe or use „liane-joaillerie”(=Liane Fleischer’s’) products, logos, trademarks or any other intellectual property rights.
10. simulate the appearance or operation of the Site, for example by using a mirror effect.
11. disrupt or interfere, directly or indirectly, with “liane-joaillerie”, or impose a disproportionate load on the Site's infrastructure, or attempt to transmit or activate computer viruses via or on the Site.

Users are reminded that violations of system or network security may lead to civil and criminal prosecution. Liane Fleischer (liane-joaillerie) verifies the absence of such violations and may call upon legal authorities to prosecute, if necessary, users who have participated in such violations.

Users agree to use the Site in a fair manner, in accordance with its purpose and with the legal and regulatory terms, the present Terms and Conditions and current practices.

ARTICLE 6: INTELLECTUAL PROPERTY

All of the Site’s content, in particular the designs, texts, graphics, images, videos, information, logos, button icons, software, audio files and others, belongs to Liane Fleischer (liane-joaillerie), the sole owner of all related intellectual property rights. 
Any representation and/or reproduction and/or exploitation of the contents and Services offered by “liane-joaillerie”, in whole or in part, by any means whatsoever, without the prior written authorisation of Liane Fleischer, is strictly forbidden and may result in legal proceedings.

ARTICLE 7: PERSONAL DATA

All personal data held by Liane Fleischer (liane-joaillerie) is collected legally and fairly in accordance with the terms of the privacy policy accessible on this site.
This data is provided by Users who voluntarily and expressly accept the present Terms and Conditions authorizing Liane Fleischer to process, disclose or transfer such data to any third party to (i) enable the User to take full advantage of the Services and functions offered by the Site, (ii) prevent any fraud and/or (iii) for statistical purposes. 

To facilitate the use of the Site and to personalize the User's experience of the Site, Liane Fleischer uses cookies and log files. The use of cookies can be deactivated by modifying the settings of the Internet browser.
Personal data is stored by Liane FLeischer for processing in connection with the use of the Services. It is kept for as long as needed to provide the Services and functions offered by the Site.
The User always remains the owner of the information concerning him/her that he/she transmits toLiane Fleischer (liane-joaillerie). In accordance with the French law n° 78-17 of January 6, 1978, in its consolidated version as of March 24, 2020, the User has the right to access, rectify and delete personal data concerning him/her, as well as the right to oppose the communication of this data to third parties for justified reasons.

ARTICLE 8: LIABILITY

It is reminded that the data published by Users and the information shared by them may be captured and used by other Users or third parties. In this case, Liane Fleischer (liane-joaillerie) does not guarantee the respect of the property of these data, it is up to the User to take all necessary measures to preserve the property of his data. 
Liane Fleischer (liane-joaillerie) does not guarantee that the Services will function without interruption or error. Liane Fleischer (liane-joaillerie)  shall not be held liable in the event of interruption of access to the Platform due to maintenance operations, updates or technical improvements. 

In any event, Liane Fleischer (liane-joaillerie) shall not be liable under any circumstances for any indirect or unforeseeable loss or damage suffered by the User.  
Furthermore, Liane Fleischer (liane-joaillerie) shall not be liable for any delay or non-performance of this agreement caused by force majeure, as defined by the case law of the French courts.   

ARTICLE 9 : AGREEMENT OF PROOF

Computer systems and files are legitimate proof concerning the relation between Liane Fleischer (liane-joaillerie) and the User. 
Thus, Liane Fleischer may validly use in the context of any procedure, for purposes of proof, the data, files, programs, recordings or other elements, received, issued or kept by means of the computer systems used, on any digital or analog media, and take advantage of them, unless an obvious error can be detected.

ARTICLE 10: INDIVISIBILITY

The fact that any provision of the Contract is or becomes illegal or unenforceable shall not affect the validity or enforceability of the remaining provisions of the Contract.

ARTICLE 11 : SETTLEMENT OF DISPUTES

The conclusion, interpretation and validity of this Agreement are governed by French law, regardless of the User's country of origin or the country from which the User accesses “liane-joaillerie” and notwithstanding the principles of conflict of laws. 
If a dispute concerning the validity, execution or interpretation of the present terms is brought before the civil courts, it will be submitted to the exclusive jurisdiction of the French courts, to which jurisdiction is expressly granted, even in the case of summary proceedings or multiple defendants.
The User is informed that he/she can in any case resort to a conventional mediation or to any alternative method of dispute resolution (conciliation for example) in case of a disagreement.

ARTICLE 12: DURATION OF THE GENERAL TERMS AND CONDITIONS OF USE

The present general terms and conditions of use are concluded for an indefinite duration, the User is held to respect them as from the beginning of his use of the Services.
The Publisher reserves the right to modify these terms and conditions at any time and without notice. The users will be informed of each update of the document.
